The general conditions of sale described below detail the rights and obligations of Captain Coco, company brand Coco Marseille SASU and its customers as part of the sale of sea trips with or without catering. These conditions of sale aim to define the contractual relationship between Coco Marseille and the buyer and the conditions applicable to any purchase made through the Capitaine Coco merchant site, whether the buyer is a professional or a consumer. All the texts and images presented on the site of Captain Coco are reserved under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited. Article 3: Quality and safety of sea trips

In order to preserve the quality and efficiency of outings at sea Captain Coco, the customer agrees to always respect the boarding conditions of age and number on board the boat specified in the reservation. In order to preserve the safety on board of all provided for by Captain Coco, the customer agrees to respect the safety conditions, ie wearing self-inflating life jackets during motor and sailing navigation. Children under the age of 12 are not allowed to travel on the passageways of the boat during motor and sailing navigation.

Article 5: Product prices

The “Sea trip” section of our site indicates the price in euros all taxes included, excluding shipping costs. The amount of VAT is specified on the final invoice generated by the customer, it is 10.00%. There are no applicable shipping costs. Captain Coco reserves the right to modify its prices at any time but the outings already reserved are invoiced at the price in force when the order is registered. The prices offered do not include discounts and rebates that Captain Coco would be required to grant taking into account the promotional offers in force. The buyer can use a voucher and modify the price of outings if he has one. A release is reserved by the full payment of the buyer at the order. The price of the products takes into account the seasonality of the tourist activity of coconut and the Marseille region. Prices are full rate from May 1, 2021 to September 30, 2021 and become reduced rate from October 1 to April 30, 2022.

Article 6: Exceptional impossibility of execution

Captain Coco is released from its obligation to deliver by the occurrence of facts beyond its control and of an exceptional nature (fire, natural disaster, transport strike, difficulty of supply, weather conditions, etc.).

Article 7: Meteorological impossibility of execution

Captain Coco is obliged within less than 72 hours of the reservation to cancel or to offer free postponement in the event of bad weather. Bad weather qualifies for the boat coconut, rough seas with waves above 1m, and a wind force of 5 or more on the Beaufort scale, that is to say a good breeze above 17 knots, and 29km/h. The reference meteorological files taken for the study of weather within 72 hours are the Arpège and Arôme models.

Article 8: Epidemiological impossibility of execution

Captain Coco is obliged within 24 hours of the reservation to modify the number of passengers, to cancel or postpone the outing in the event of a ban on sailing or gathering due to an epidemic of Covid-19 and its variants.

Article 9: Cancellation and refund

The customer may at any time modify the date of his reserved outing for the reasons incumbent on him. The client does not have to justify the reasons for which he is responsible for a postponement due to him. To do this, he must go to the section “ Cancelation " of the site www.capitainecoco.fr and complete the deferral request form. A fee of 15 € will be applied in the event of cancellation of the outing. No charge will be applied for postponing the outing. On the other hand, the postponement may be refused in the event of the boat's unavailability. coconut, or if the postponement occurs beyond the seasonal limits applied for the rates in force. Article 10: Orders

The customer validates his order when he activates the "Reserve" link at the bottom of the "Product" page after having accepted these conditions of sale. Before this validation, it is systematically proposed to the customer to check each of the elements of his order; he can thus correct any errors. Captain Coco confirms the order by e-mail; this information includes in particular all the elements of the order and the customer's right of withdrawal. Captain Coco reserves the right to refuse any order presumed to be fraudulent, or doubtful or in the event of non-payment. The data recorded by Captain Coco constitute proof of the nature, content and date of the order. This is archived by Captain Coco under the legal conditions and deadlines; the customer can access this archive by contacting customer service.

Article 11: Methods of payment

The price is payable when ordering in euros. The possible method of payment is by credit card (via PayZen), by American Express card or by direct debit (directly by telephone). Payzen and American Express payments are made through a secure system such that the information transmitted is encrypted and no third party can read it during transport on the network.

Article 12: Delivery

Delivery to your home Products purchased on the site www.capitainecoco.fr are delivered in metropolitan France (excluding DOM TOM and Corsica). For delivery abroad, contact Capitaine Coco by email before ordering. When the item is available in stock, the delivery deadline is determined by the sum of the following 2 elements:

  2. The delivery time of your package by the carrier: The delivery service is done with the Chronopost offer.
Delivery rates Shipments to CHRONOPOST France are subject to VAT subject to the application of the rules of territoriality. Receipt of the package For shipments, Captain Coco could not be held liable in the event of theft from the customer's mailbox (if La Poste declares the package as "delivered") only the declaration of La Poste is authentic. If Chronopost returns a parcel for the authentic reason: The recipient does not live at the address indicated, the customer will receive a credit note (purchase costs/excluding postage) and will have to place his order on the site (or by email) and correct his address, the postage will then be at his expense. Note that all our items leave our premises in perfect condition. If the customer accepts a damaged package, or if the package has been put directly in the mailbox, the protest must be made by registered letter with acknowledgment of receipt to Chronopost within 2 days of delivery. Any item damaged during transport cannot be exchanged or refunded if no reservations have been notified upon receipt of the package. Late delivery In the event of a delay in delivery by Chronopost within 8 working days following the date of shipment, the customer should contact Chronopost. Chronopost's investigation can last up to 21 working days from its opening date.
  • If during this period, the product is found, it will be re-routed to the delivery address indicated by the customer when ordering.
  • If, on the other hand, the product is still not located at the end of these 21 working days, Chronopost will consider the parcel as lost. In this case, Capitaine Coco will return a replacement product to the customer at its own expense. If the product is no longer available, Capitaine Coco will reimburse the product concerned by the declaration of loss confirmed by Chronopost Food.
Only the declarations provided by Chronopost will be valid. Wrong product In case of error in sending a product, simply return it to us (at our expense), the item will be refunded to you by voucher or via Payzen.

Article 13: Withdrawal

In accordance with article L 121-20 of the consumer code as amended by order 2001-741 of August 23, 2001, the withdrawal period is 14 days. Food products are neither taken back nor exchanged (for hygiene reasons). For non-food items, the buyer must first notify customer service by hello@capitainecoco.fr specifying the order number, the products and the reference as well as the reason for this return (optional).
