Captain Coco Brand owned by Coco Marseille SASU

Article 1: object

These general terms and conditions of sale (GTCS) describe the rights and obligations of Capitaine Coco, a brand of Coco Marseille SASU, and its customers in connection with the sale of sea outings with or without catering. These conditions apply to all purchases made via the Capitaine Coco website, whether the buyer is a professional or a consumer.

Article 2: Product information

The characteristics of the products offered for sale are detailed in the «Sea outing» section of the site. www.capitainecoco.fr. These products and services are offered while stocks last. For further information, the customer may contact Capitaine Coco by e-mail at hello@capitainecoco.fr. All texts and images on this site are protected by copyright and intellectual property rights. Reproduction, even partial, is strictly forbidden. Tours are available from 10:00 am to 10:00 pm, depending on the availability of the Coco boat.

Article 3: Quality and safety of sea trips

To guarantee the quality and safety of our outings, customers must comply with the boarding conditions in terms of age and number of passengers, as specified at the time of booking. Self-inflating life jackets must be worn during sailing. Children under 12 years of age are not allowed on the gangways of the boat during navigation.

Article 4: Place of embarkation and disembarkation

By default, embarkation and disembarkation take place at Port du MUCEM, J4, 13002 Marseille. For all requests to embark or disembark at another port, please contact Capitaine Coco by e-mail (hello@capitainecoco.fr) or via the «Contact» of the site.

Article 5: Product prices

The prices indicated on the site www.capitainecoco.fr are in euros, all taxes included, and calculated excluding shipping costs. VAT of 20 % is included in the final invoice. Capitaine Coco reserves the right to modify its prices at any time, but booked outings will be invoiced at the price in force at the time of order. Prices vary according to season: full price from May 1 to September 30, reduced price from October 1 to April 30.

Article 6: Exceptional impossibility of execution

Capitaine Coco is released from its performance obligation in the event of force majeure, such as fires, natural disasters, strikes, or other events beyond its control.

Article 7: Meteorological impossibility of execution

Capitaine Coco may cancel or postpone the outing free of charge in the event of adverse weather conditions in the 72 hours preceding the outing. Rough seas with waves of over 1 meter or winds exceeding 17 knots (force 5 on the Beaufort scale) justify such a decision. Arpège and Arome weather models are used as reference.

Article 8: Epidemiological impossibility of execution
Capitaine Coco reserves the right to modify the number of passengers, cancel or postpone the outing within 24 hours of booking in the event of restrictions due to an epidemic, such as a ban on sailing or gathering.

Article 9: Cancellation and refund

Customers can change the date of their outing without having to justify the reason. To do so, they must complete the postponement request form on the website www.capitainecoco.fr. No fee is charged for cancellations or postponements. Capitaine Coco reserves the right to refuse a postponement if the boat is unavailable or if the postponement exceeds seasonal limits. Capitaine Coco may also cancel an outing up to 72 hours before the scheduled date for exceptional weather or epidemiological reasons, with a full refund of the fare paid.

Article 10: Orders

The customer validates his order by clicking on «Book» after having accepted the GTC. An order confirmation will be sent by e-mail. Capitaine Coco reserves the right to refuse any order suspected of fraud or non-payment. The data recorded constitutes proof of the nature, content and date of the order, which is archived in accordance with legal requirements.

Article 11: Methods of payment

Payment is due with the order in euros. Payments are made by credit card via PayZen Lyra, American Express, or direct debit (by telephone). Transactions are secured by encryption to protect transmitted information.

Article 12: Delivery

Products are delivered in metropolitan France (excluding DOM TOM and Corsica). Deliveries abroad require a prior request by e-mail. Shipping costs are applied according to the conditions of the carrier, notably Chronopost, and include VAT. Capitaine Coco cannot be held responsible for theft after delivery confirmed by the carrier. In the event of delay or loss, claims must be made directly with the carrier.

Article 13: Withdrawal

In accordance with article L 121-20 of the French Consumer Code, the cooling-off period is 14 days, except for food products, which cannot be returned or exchanged. For other items, the customer must return them in perfect condition, accompanied by all documents, to Coco Marseille - 31 La Canebière - 13001 Marseille. Return shipping costs are at the customer's expense.

Article 14: Customer relations – After-sales service

The Customer Relations department can be reached from Tuesday to Friday, from 10am to 5pm, on +33 (0) 7 79 52 03 57 or by e-mail at hello@capitainecoco.fr.

Article 15: Data processing and freedoms

Personal information is necessary for order management and commercial relations. In accordance with the French Data Protection Act of January 6, 1978, updated in 2004, customers have the right to access, rectify and object to data concerning them. To exercise this right, please contact hello@capitainecoco.fr by providing proof of identity.

Article 16: Miscellaneous provisions

These terms and conditions and the order summary form a contractual whole governing relations between Capitaine Coco and the customer, subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction. Capitaine Coco undertakes to seek an amicable solution before taking any legal action.
